Včeraj sem na Novi 24 TV, zvečer, ob 20. uri in deset minut /op. uredništva: spisano 20. 1. 2011/, z velikim zanimanjem spremljal pogovor s štirimi slovenskimi sodniki. Vprašanja jim je pogumno in pronicljivo zastavljal Luka Svetina. Odgovarjali so: Zvjezdan Radonjić, Ernest Petrič, Jan Zobec in Peter Jambrek.
Morda se motim, zato prosim, da me kdo od vas, ki ste dotični pogovor spremljali bolj pozorno od mene, obvesti, kolikokrat je kateri od sodelujočih bežno – vsaj mimogrede – zna biti samo nehote – omenil nežno – lahkotno – osrečujočo – zdravilno – po vsem svetu znano – besedico: vest?
Ni rečeno, da mora vsakdo od nas vedeti, kaj je to vest – ali celo – kaj je čista vest. Za poklicno sodnico ali sodnika pa je vsekakor nujno, da ima vest in da je le-ta čista. Zakaj torej v vseh 50 minutah strokovnega pogovora na temo nadaljnje smeri delovanja slovenskega sodstva nobeden od častivrednih prisotnih ni omenil osebne vesti, ki je neobhodna za rehabilitacijo slovenskega sodstva?
Na vseh prisotnih sodnikih je bilo videti, kako zelo jih mori breme težke odgovornosti. Opaziti je bilo mogoče posamično in skupno prizadevanje, da bi poiskali pot iz gostega, do vesolja smrdečega sodnega dreka, v katerem naše sodstvo tiči vsaj do vratu, če že ne čez.
Ne opravičujem se za izraz drek v prejšnjem stavku, saj je smiseln, opravičljiv in upravičen. Videti je bilo, da celo najbolj eminentni, spoštovanja vredni, modri, pravični, vsestransko izkušeni slovenski sodniki ne najdejo izhoda – rešitve – iz zagatnega stanja slovenskega pravosodja.
Kako razrešiti položaj, v katerega je sebe in njih spravil duhovno neprebujeni Branko Masleša podcenjevalno in zaničevalno skrivajoč dokaze o svoji usposobljenosti za pravično, pošteno in smiselno (z eno besedo vestno) sojenje?
Zame ni več pomembno, ali ima gospod Masleša diplomo, doktorat, pravosodni izpit, uporabno dovoljenje, vozniško dovoljenje … Zame je bistveno, da nima pojma o tem – kaj je vest – in – kar je še huje – dokazal je, da vesti sploh nima. To je dokazal s tem, da je na povsem legitimno zahtevo, naj ljudstvu pokaže papir – dokaz – diplomo – potrdilo, da zna in sploh sme soditi, odgovoril z grožnjo. Četudi morebiti ima pravosodni izpit, je gospod Masleša s svojimi sodbami, besedami in dejanji dokazal svoj značaj, napuh, domišljavost, nesposobnost, neprimernost in neusposobljenost za delo sodnika. Svojih grdobij ne more več popraviti, četudi bi imel in pokazal vse diplome tega sveta.
In kaj zdaj? Štirje ugledni slovenski diplomiranci, pravniki, varuhi vladavine prava, nedvomno formalno brezhibno usposobljeni … celih 50 minut na mojem televizijskem zaslonu samo zmajujejo z glavami. Ne vedo. Se čudijo. Zelo zapleten položaj. Menda celo Nemcem niti z izvedeno lustracijo v Vzhodni Nemčiji ni prav dobro uspelo … Ni izhoda … strašno … pravzaprav grozno … človek bi dejal zastrašujoče … Ali pa zgolj in samo strahopetno?
Nekateri na moje pisanje porečejo: Klarič spet moralizira o nekakšni neotipljivi, nemerljivi, abstraktni vesti, ki – kdo ve – ali sploh obstaja … eno samo filozofiranje ….
Kot vedno, kadar kaj pišem, snemam, ustvarjam … sem se tudi v tem primeru obrnil na svojo vest. Potrebovala ni niti pet sekund. Brez vsakršnega – zlasti pa nepotrebnega – odlašanja in kar mimo potrdila o doktoratu, ki ga seveda nimam, mi je odgovorila:
Vsaka država, oziroma njena demokratično izvoljena vlada, ima v primeru tako grobega sodnega posega v človekove pravice možnost in dolžnost, da ukrepa. Če tega ne stori, vlada tudi sama krši ustavne določbe o tem, da je Slovenija pravna država. V našem primeru pa je kršitev na državni ravni še veliko hujša. Vse namreč kaže, da je vodenje sodstva prevzel organiziran kriminal s podedovanim trajnim mandatom in imuniteto. Več kot dovolj je razlogov, da vlada opravi svojo sveto dolžnost, da po najhitrejšem možnem postopku, na nujni državnozborski seji sprejme zakon za učinkovito varovanje človekovih pravic, varovanje ljudstva in varovanje pravne države. Da nam končno zagotovi vestno (smiselno) delujočo, pošteno in pravično in ne kakršnokoli vladavino prava. To bi vlada zagotovila s pripravo in parlamentarnim sprejemom zakona, ki bi mimo omejujočih pristojnosti sodnega sveta in sodniške imunitete omogočil pravično kaznovanje podkupljivih oziroma kompromitiranih sodnic in sodnikov, ukinitev trajnih mandatov in ustanovitev od sodnega ceha neodvisne inšpekcije, ki bo zadolžena za odpravo nepravilnosti in korupcije v sodstvu. Ob tem naj vlada državljanom omogoči pravično odškodnino ali obnovo postopkov, ki so jih vodili kompromitirane sodnice in sodniki.
Obstoječa vlada navedeno lahko stori in tudi mora storiti takoj. Ni dvoma, da država denarno zmore plačati odškodnino. Gre za resnično in pravično takojšnjo odškodnino vsem prizadetim, ki lahko dokažejo, da je na sojenje bodisi s statusom vrhovnega sodnika ali kakorkoli drugače s svojo brezvestnostjo vplival sodnik Branko Masleša. To države ne bo uničilo, le okrepilo jo bo. Vsekakor pa bo pomenilo nujen preobrat v smeri vestno vodene vladavine prava.
Gre predvsem zato, da vladavino prava v Sloveniji nikoli več ne bo obvladovala globoko inkriminirana, brezvestna sodniška miselnost, ki bi ji moral v Sloveniji – že ob osamosvojitvi – poteči rok trajanja.

je prava podrtija, ki samo čaka, da nekdo spodmakne eno samo opeko, ma ne opeke, en kamenček in se bo vse skupaj s Pogačnikom vred podrlo v Ljubljanico…izstopata, hvala bogu zakonca Zobec, Šorli, Radonjić in konec, nobenega premika mase dobrih sodnic in sodnikov, tožilcev…barka naluknjana in zmajana kar pluje. Kopičijo se nečloveškosti, kršenje človekovih pravic, izgubljene zadeve na EU sodišču, čez 300 milijonov denarja za pokrivanje barabinskih sojenj je že poniknilo in stvari stojijo, Bastilja milana kučana-Lažgošarja , Krivosodje še kar stoji.Državni tožilec kar gre k Putinu in h kriminalcu tožilcu Rusije, brez, da fašistična oblast sploh ve po kaj in zakaj…nevarna razmerja.
Ne vem, g.Klarič, sem mislil, da bom kaj povedal, pa ne znam Težko, zapleteno, berlinski zid je padel na vse strani, ne na samo eno, JLA nismo nagonili iz države, pravijo in pišejo, da so se odpeljali, ja tudi po morju. Še danes ne vem zakaj iz Kopra v Črno goro, mater so ga moral žurat na tisti barki…pa balkanski bojevniki so na prostosti, pa napadalci na novinarja Petka tudi, pa uničevalci naše urednice Mojce se tudi sprehajajo svobodno naokoli in uživajo prelesti Domovine, enako je z zarotniki proti Kanglerju, vsi akterji so napredovali in se šopirijo naokoli…ne vem g.Klarič. Težko. Je pa nekaj. Bandelli, Golob, kučan in podobni so obljubili, da bodo počistili in še delajo platforme ter programe. Bomo videli. Očitno še veliko dela za Krivosodje, namestnik Masleše si že kroji novo obleko za pred kamero. Ali bo novi precednik RS iz Mc Čeferinovega klana imel težavo izbrati? Ne. Itak mu bodo servirali kandidata v celofanu z mašnico na pladnju z diplomo in s sodniškim ispitom, vse v nulo in bo šlo po starem koloseku in psi bodo lajali na rdečo karavano… Pokorno javljam, da planeti čudno stojijo.Težko.
